Supreme Court May Adopt Nixon V. Fitzgerald Standard in Deciding Whether to Grant Trump Immunity: Analyst

The Supreme Court is set to hear arguments Thursday on whether former President Donald Trump should be granted immunity in his 2020 election case. NTD spoke to John Malcolm, the vice president of The Heritage Foundation’s Institute for Constitutional Government and the director of the Meese Center for Legal and Judicial Studies, to find out more about the legalities.

He told NTD he expects the United States’ highest court to adopt—in President Trump’s criminal case—the Nixon v. Fitzgerald legal standard, which finds a president immune from civil liability for any acts made as president that fit within the outer perimeter of his duties as president.
