Some Arizona lawmakers are considering an unorthodox legal means to get Congress back into session and potentially choose the state’s presidential electors itself.
State law says only the governor or two-thirds of the state legislature can call a special session—neither is likely in Arizona—the governor recently certified the election results and Democrats have shown no interest in the fraud allegations.
But in the case of choosing electors, the U.S. Constitution gives the power to the state legislature and that could supersede the state law for calling special sessions.
In Arizona, there are 17 state senators. In a special session, 16 of them would need to support reclaiming their authority.
One senator there, Sylvia Allen, doesn’t think there’s enough appetite right now but her colleagues are reviewing the evidence from Monday’s hearing. And a Republican congressman, Paul Gosar told NTD they won’t know until they try. He’s convinced there’s fraud and says the state legislator has a duty to protect the vote.
